The Last Will and Testament of James Johnston-1816-Charlotte County, Virginia
In the name of God Amen: I James Johnston of Charlotte Co., VA, being weak in body, but of sound mind and memory do make and ordain this to be my last will and testament in a manner and form following: to wit: item - I desire my executor, hereafter named, in the first place, to pay all my just debts and funeral expenses. Item - it is my will and desire that all of my estate both real and personal be equally divided amongst my children. Item - it is my will and desire that my estate be kept together until Christmas next. Lastly, I do hereby appoint my son-in-law Matthew Davenport and my son, William Johnston, Executors of this my last will and testament hereby to rescind all former wills by me made. In witness whereof, I have hereunto set my hand and seal this the nineteenth day of April 1816.

In Court held for Charlotte Co. the 6th day of May 1816: This last testament of JAMES JOHNSTON, that was presented in Court and the same was proved by the Oath of William Dabbs and John Roach, two of the surviving witnesses to be acknowledged by the said James Johnston as his last will and testament in their presence and ordered to be recorded and on the motion of Matthew Davenport and William Johnston, the Executors named in the will, who made according to law, certificate is granted them for obtaining a probate and the said will of due form they giving security whereupon they with John Johnston, Robert Johnston and John Roach, their securities entered into and acknowledged their bond according to law for that purpose.

We, William Gaines and Robert Morton, magistrates for said county do hereby certify that William Johnston and Patsy his wife, Alvin Johnston, Robert Johnston, James Johnston and Patsy his wife, John Johnston and Judith his wife, Robert Robson and Sally his wife, Matthew Davenport and Polly his wife, Francis M. Thompson and Elizabeth his wife, John Thompson and Crochan his wife, Hickerson Johnston and Mary Ann his wife, Nancy Johnston and Samuel Johnston parties to the written conveyance have duly acknowledged the same before us on the 15th day of August 1816 and desires us to certify the said acknowledgement to the Clerk of the County Court of Charlotte in order that the said conveyance may be recorded as notarys, our hands and seals.
