This instrument was proved on 24 January 1793, indicating he had died in the interim period. The heirs he named in this document were his children and grandchildren by his first wife Judith Segar. They were son Joseph, daughters Jane Segar Coche (Cocke), Ann Hardaway, Mary Meade, and Mary Archer, and son in law John Archer; granddaughter Judith Eggleston Coche (Cocke), and grandson Seth Hodges Meade. The Executor was his son Joseph Eggleston. The signatory witnesses were Edmund Eggleston, Richard Eggleston, and James Craig. In this document he specified the desire to be buried near his deceased (first) wife. He also specified that his current wife, Judith Cobbs, was to be provided for with a room and that a son was "to manage her fortune from Capt. Wm. Bentley as he is obligated to pay her as long as she shall live." This man is believed to have been a son of Judith's first husband and who married Judith Archer on 14 May 1782 in Amelia County. From his provision for his second wife Judith Cobbs, it would appear that she had no children by her first husband John Bentley to care for her.
